Permitted Use

You agree that you are only authorized to visit, view, and retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify, or otherwise distribute the material of this Site for any commercial use, or for any purpose other than as described in these Terms. You also agree not to deep-link to the Site for any purpose, unless specifically authorized by Emotional Branding, LLC (“EB”). By using this Site, you acknowledge that you have read all of the disclaimers and policies contained herein and that you accept and will be bound by their terms.

Memberships

Memberships for Partners, Insiders and Co-Producers are offered by written contract only, the terms of which may vary based upon the nature of the work being undertaken. Membership programs at each level are subject to modification or termination in the event a minimum subscription level is not achieved, in EB’s sole discretion. Written contracts will also provide for reimbursement of out-of-pocket expenses as provided therein.

Informational Content Disclaimer Policy

Any information and downloadable software provided on this Site is provided “as is” and all warranties, express or implied, are disclaimed, including, but not limited to, any implied warranties of merchantability, merchantability of any computer program or software, fitness for a particular purpose, accuracy of informational content, or system integration, or non-infringement. EB’s maximum liability for any inaccurate information or software and your sole and exclusive remedy for any cause whatsoever shall be limited to the amount paid by you for the information received (if any). EB is not liable for any indirect, special, incidental, loss of business, loss of profits or consequential damages, whether based on breach of contract, breach of warranty, tort, negligence, product liability or otherwise, even if advised of the possibility of such damage.

Chat Rooms, Forums, and Message Boards

The Site may make message boards available to its users. You are not required to provide any personal information when using these areas but you may choose to do so. If you post personal information online, it will be publicly available and you may receive unsolicited messages from other parties. We cannot ensure the security of any information you choose to make public in a chat room forum, or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. Please exercise caution when deciding to disclose personal information in these areas. Message boards are run in-house by EB and no information is collected by any third party.

EB’s Property Rights

You agree that ownership in all content generated by EB shall be EB’s exclusive property and that you may obtain title thereto only pursuant to separate written contractual agreement with EB. You agree not to distribute, license, or create derivative works from any of EB’s material, including graphic files and software, except as expressly permitted by EB. You agree not to reproduce, copy, duplicate, or sell any portion of the EB Site.

Offline Conduct

Although EB cannot monitor the conduct of its users off the Site, it is a violation of these rules to use any information obtained from the Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any user without his/her prior explicit consent.

Unauthorized Use of the Site

Illegal and/or unauthorized uses of the Site, including, but not limited to, unauthorized framing of or linking to the Site or unauthorized use of any robot, spider, or other automated device on the Site, will be investigated and subject to appropriate legal action, including, without limitation, civil, criminal, and injunctive redress.

Termination of User Account

EB may, at its sole discretion, terminate any user’s account for any reason. Under no circumstances shall EB be liable to any user or any other party for such termination.
